Services Provided

DevTom offers website development, design, and maintenance services tailored to businesses of all sizes. We also offer custom solutions and consultancy services related to website optimization, security, and management.


Payment Terms

  • A 60% deposit is required to begin any website development project. The remaining balance is due upon completion, before the website is handed over to you.

  • Payment is processed securely through VISA, Mastercard, Mpesa or other approved methods.

  • Any additional work outside the original scope of the project will be billed separately and must be agreed upon in writing.


Intellectual Property

  • All website designs, code, and content created by DevTom are the intellectual property of DevTom until full payment is received. Upon payment, the ownership of the website is transferred to the client, except for any third-party software or content used.

  • You may not reuse, replicate, or resell the designs, code, or content without prior written consent from DevTom.

  • We may display completed projects in our portfolio unless a client specifically requests otherwise in writing.


Client Responsibilities

  • You are responsible for providing accurate and complete information necessary to complete the project, including any required content, logos, images, and other materials.

  • Any delays in providing materials may affect the timeline of the project.

  • You must review and approve the website at each project stage to avoid delays. Failure to provide timely feedback may result in additional charges.


Website Maintenance

  • We offer ongoing maintenance packages that include updates, backups, and technical support. If you opt for a maintenance plan, you agree to pay the recurring fee based on the agreed terms.

  • DevTom is not responsible for website issues resulting from changes made by third parties, including unauthorized modifications or installations made outside of our maintenance services.


Cancellation and Refunds

  • If you wish to cancel a project after work has begun, the deposit is non-refundable due to the time and resources already allocated.

  • For ongoing services (such as maintenance), you can cancel at any time, but no refunds will be issued for the remaining period.


Limitation of Liability

  • DevTom will not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the website or services.

  • We do not guarantee that the website will operate without interruptions or errors, but we will work to resolve any issues that arise within a reasonable time frame.

  • Any third-party tools, plugins, or services used on your website are subject to the terms and conditions of their respective providers.


Confidentiality

  • Any information you provide to DevTom as part of our services, including project details, will be treated as confidential.

  • We will not disclose your information to any third parties without your consent unless required by law.


Termination

  • DevTom reserves the right to terminate or suspend services if you fail to meet payment deadlines, provide necessary materials, or engage in any unlawful activity.

  • If services are terminated due to non-compliance with these terms, no refunds will be issued.


Third-Party Services

Your website may integrate with third-party services (e.g., payment gateways, analytics tools). DevTom is not responsible for the performance or availability of these services, and their use is governed by their own terms and conditions.


Changes to Terms and Conditions

DevTom reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on this page with an updated effective date. Your continued use of our website or services after the posting of any changes constitutes acceptance of those changes.


Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Kenya. Any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts of Kenya.
